Hacienda del Mar Resort is a resort in Cabo San Lucas, Mexico, with its own timeshare program. It is owned by RCI, the biggest timeshare/vacation rental company in the world.

We signed a contract last August for a one bedroom timeshare with the understanding that we had purchased an every-year program. However, when we returned this past January to stay at the Hacienda del Mar resort for the first time under the contract that we had signed, we were astounded when we heard the sales person say when reviewing our contract with us that we had actually purchased an every-other-year program. Also, when we expressed our disbelief when the Hacienda del Mar sales staff said that we only owned a every-other-year program, instead of the sales staff sitting down with us addressing our concerns immediately, they said come back after hours and we were quickly ushered out of the meeting, as if trying to hide their practices from other potential clients, or to get rid of us because we weren’t going to purchase anything.”
  • “We were sold an additional unit (jr. suite) under the pretext [sic] that that was the only way we would have access to the new resort they are developing on another site. (We have learned this is not true.) … We had to sign over the suite to a rental company for 3 years, pay additional funds to the rental company, and not have access to the jr. suite for 3 years. Needless to say, we never received a dime from the rental company and they would not respond to our attempts to contact them. We didn’t want/need the unit in that we already own a large unit and purchased it only so that we would have access to the new property. We are now ‘stuck’ with the annual maintenance fee. We have never used the unit. We have asked the sales department to ‘dissolve’ our contract in that is was purchased under false information as well as fraud with regards to the rental company. We don’t want a refund of our purchase price; we just want to have to stop paying an annual maintenance fee. … We have been brushed aside with delaying tactics and further untruths. We write this to warn other guests that many of the things you are told at sales presentations are absolutely not true. “

And they wanted the money up front.
  • “Booked family vacation through special offer from corporate vacation fax. IRR Marketing Co. misrepresented hotel and location of hotels. We were told we would be staying at either Sunset Royal or Sunset Lagoon, only to discover that we had been down graded to the Ocean Hotel because of the size of our party. … Time share tour was horrible. I explained the deceptive marketing tactics and was told we should not have expected those hotels for the price we had paid for the corporate vacation package and that we should not hold it against the hotel for the marketers sales tackets [sic]. Representative kept referring to the Ocean Hotel as a less than standard hotel that had no association with the Sunset Hotels, which I discovered later had no truth to it. After several managers tried different sales approaches on us, my husband got angry and got into an argument with a Closer Manager who finally asked us to leave.”

  • “This is the worst hotel i’ve ever stayed at. … Only good thing about this place is that the staff is friendly … We ended up switching hotels and letting them keep our money. To top it off, the manager tried to scam us out of $400 USD by making up some BS story about the hotel switch. I was never informed for of that so i didnt pay and she never contacted again. In short, save your money and go somewhere else. Didn’t even want to take pictures.”
  • “My friend was invited to stay there to attend a timeshare presentation, so you would think they would be on their best behavior in that early stage of soliciting potential business. Instead, they SCAMMed me from the minute I arrived, presenting documents they said were for check in purposes only, when they knew we had just gotten off a redeye flight and had only minutes to catch our ride to an all day Chichen Itza tour. But, would most people expect that any legitimate business would try to ‘sneak in’ a document that locks you into an entirely different thing than what it was presented as (a simple check in document)?  This place looks like a 4-star hotel, but behaves like a no-star, no-class motel from hell.”

To add to this, the managing company, the Vacation Store of Miami, has a reputation for using  bait-and-switch practices that lead people to pay for hotel and timeshare reservations that they never end up getting to use.   • “My husband & I recently returned from Ocean Coral & Turquesa H10. We had trouble with the rooms. Our first room was on the first floor and was not aired out. It had a strong musty smell. … We were told that was all they had…Until we signed up for the sales pitch for RCI Premium club. I felt like we were put in that first room as part of their sales pitch. When we went to get our “free gift” at the RCI Premium Club, one of their staff stepped in and was able to get us a room on the 2nd floor that was properly aired out and had a King size bed suitable for a couple. Hard to believe it was not actually available the day before when we checked in. But when the RCI Sales person had us looking to sign up for a meeting regarding their vacation program, they were miraculously able to pull off a room without a musty smell and a king size bed….but we had to listen to their sales pitch. Which we politely did….for 4 hours.

    Occidental Allegro is a family of hotels and resorts located in Mexico. Their destinations, among several others, include Cozumel, Punta Cana, and Playacar. They are owned by the Vacation Store of Miami. 

    Their timeshare program is called Occidental Vacation Club, which can be found at each of Occidental Allegro’s hotels and resorts. Occidental Vacation Club appears to be owned and managed by a company called Allegro Holdings, and part of the Barceló Hotel Group (which claims to be connected with RCI, but it’s unclear whether or not this is true). 

    While this might cause some confusion, make no mistake that these are the same resorts — and apparently, part of the same timeshare scam. This is the heart of the many complaints people have had about this timeshare program. More specifically, they’ve cited:

    • Bait-and-switch practices
    • Constantly booked properties 
    • Poorly maintained rooms that do not reflect what was promised
    • Tacked-on charges and constantly increasing maintenance fees
    • High-pressure sales tactics and false promises

    Furthermore, some of the many comments we found were about fraudulent activity. Specifically, here are a few of the most noteworthy. 

    From TripAdvisor:

    • “If you are staying at any of the Occidental hotels, and are being pressured to purchase a vacation club membership, do not buy it!!!! This is the biggest scam out there! The agent will show you a spectacular room with flat screen televisions, and beautiful accompaniments, but when you stay there you’ll get a second rate room with none of the niceties they showed you. If you are unfortunate enough to have already bought a membership, it is basically worthless, as they sell on EBAY for $5.00.
    • “It was nice visiting Allegro/Occidental hotel, but please never attend one of the timeshare that is offered at the property. The timeshare is a SCAM. Please never sign in to buy anything while vacationing there. We have made a mistake in buying the timeshare and we have not had the opportunity to use it because we still have to pay for the same price to stay at the hotel even though we already have the Allegro/Occidental Vacation Club membership. We have reached out to the individuals at the property with the request to be released from the contract and forfeit the $15,000 that we already paid into the membership, but we have not heard back to resolve the issue. I will continue to go on to other social media platform to warn others of the TIMESHARE SCAM practices. … Please say no to buying Allegro/Occidental Vacation Club membership because it’s a worthless club membership. … I am thinking of finding enough people to file a Class Action Lawsuit against the vacation club.”

    • “This company will tell you anything you want to hear to get you to buy into the company, they will show you wonderful pictures (but when you go to get those they are always a grade up from you) I own what they say is the best they have 2 bedroom royal club, but yet to get a room like in the book in aruba you have to upgrade? … It’s also getting to a place you need to book over a year in advance because they have over sold the time share and now have more owners than space, but if you go on line you can book a room and if you call under your time share they will tell you it’s full. So again scam.

    From Defaulters:

    • “We had the misfortune of getting sucked into a “90 minute” presentation for the Allegro Vacation Club while in Playa del Carmen. We had purchased discounted tickets for Xcaret and this was a part of the deal. … They had our licenses and credit cards and we could not leave and the salesman and his wife, the sales manager, kept presenting different plans over 2 hours. … After we received the materials we learned we had been the victim of a bait and switch and what we had been given was unfeasible for us. We had to book 14 days out and pay up to 48 hours out with no refund for cancellations! We returned 2 days later to cancel and get a refund. The salesman refused and kept saying that what he told us trumped the contract and language of the certificates! He then started swearing at us and threatening us. … Beware – these people are excellent salespeople who will wear you down and create an offer based on what you say during the presentation, then screw you. Also, the date on the contract was wrong, probably to prevent a challenge of the 5 day window to cancel. Fortunately we caught that and made the changes to our copy of the contract. They are dishonest, sleazy people!”

    On top of this, their owning company, Allegro Holdings, has a C+ and is unaccredited with the BBB; the Vacation Store of Miami, which seems to be involved somehow, is notoriously low-rated, with several BBB complaints and 2 stars on Yelp. Occidental Vacation Club itself has 1 star on ComplaintsBoard from 3 reviews, as well as several notable complaints on Timeshare Marketplace, RedWeek, and Defaulters.

    So if you are looking to get rid of Occidental Allegro timeshare, you would be well justified in doing so, and fortunately have several options at your disposal.

    Escondido Towers is a resort-style condominium community located in Mazatlan, Mexico. At one point Escondido Towers may have had a timeshare program. Currently the property is managed by a company called Mazatlan4Rent, and units can be found for sale and for rent online by various realtors, as well as on Airbnb. 

    One might assume from this information that the Escondido Towers timeshare program is no longer in existence. While we could not determine whether or not the program is still around, the fact remains that if you bought into this property you may want to cancel Escondido Towers timeshare. 

    The only reviews we found of Escondido Towers came in the form of TripAdvisor discussions from buyers of fractional ownership (which is similar to a timeshare, but not the same) who had trouble getting in touch with the sales managers immediately post-purchase. Those sales managers eventually got in touch by posting their information on those threads, which is not necessarily a red flag, but is definitely a bit strange. Those communication difficulties might still exist considering the lack of other information available online about Escondido Towers.  Fortunately, in spite of this, there are still several ways you can get rid of Escondido Towers timeshare.

    What is Fractional Ownership?

     

    If you’ve invested in Escondido Towers at any point, it can help to understand the difference between a timeshare and fractional ownership. A timeshare purchase is supposed to give you, the buyer, the right to make use of a vacation property for a certain length of time each year. Every buyer is meant to have the same right of usage, but the property owner still holds rights to the title. In contrast, while a fractional ownership is also supposed to provide the buyer with a similar amount of limited annual access to a property, it also makes each buyer a part owner, giving them all an equal part of the title. 

    While fractional ownership may sound a bit like a better deal than your average timeshare, it generally isn’t. The same kinds of fees can be involved in a fractional ownership, and the same management and quality problems can exist with the property.     That said, if you wanted to try and work directly with Mazatlan4Rent to get out of Escondido Towers timeshare, you could go to their website instead and get in touch via the Contact page. You could also click through to their sales website, Mazatlan4Sale, and find a means of getting in touch through that platform. This company looks to have a solid BBB rating, so it’s certainly worth looking into.

    Can You Get Rid of an Avalon Vacation Club Timeshare?

    Avalon Vacation Club is a timeshare program in Cancun, Mexico, that is part of a larger management agency called the Vacation Store of Miami. It was previously associated with Avalon Resorts and their several properties, including Avalon Grand Cancun, Avalon Grand Panama, Avalon Reef Club Isla Mujeres, Avalon Excalubur Acapulco, and Club Baccara. It is now part of a hotel called Hotel NYX Cancun, which is also known as or was once called Avalon Grand Cancun.

    We found a report on a website called Timeshare Consumer Protection Alerts and Advisories, or TCPAA, that noted the history of these resorts, seeing as it’s difficult to find much information elsewhere online. They note that “Avalon Resorts provides timeshare properties and enhanced memberships into their popular Avalon Vacation Club,” but also that the former owner ran into legal trouble, which changed the face of the resorts. Unfortunately it has some old, nonworking links, so it’s not as up-to-date as it could be. 

    But the information is still cause for concern. So if you have ended up saddled with a timeshare from this company, and want to cancel Avalon Vacation Club timeshare, you are certainly not alone and there are options you can pursue. 

    While researching this timeshare program, we found several complaints online, most of them not limited to Avalon Resorts’ past problems with bad management. Here are some of the most noteworthy comments and reviews we found for Avalon Vacation Club, Hotel NYX Cancun, and the Vacation Store of Miami. 

    From TripAdvisor:

    • “We are members of Avalon Grand Cancun & we are wondering what is going on with the new management. We have not received any information. We found out it is no longer a part of the Avalon Resort group & has been removed from the website. We have tried to contact the vacation club manager, who had nothing to say! We are ready to start a class action suit because we have a contract, and as members, we are kept in the dark about this.” 

    From the BBB:

    • “Due to Covid, my wife and I had to reschedule our honeymoon from 2020 into 2021. We paid the original price of what our honeymoon was supposed to cost in full amount of $1,970. The COVID pandemic forced us to reschedule our vacation (in which we were happy to keep with the same resort to try to help the company in this trying time period). Yet, Vacation Store Miami has now demanded we owe an additional $204 because they have increased the price of our already paid for vacation. When I asked for a refund, the employee told me they only allowed store credit. This action is trying to force us to pay more than what was advertised. This is also holding our money hostage by forcing us to take a “credit” that would be required to be used for a less quality room. This is terrible business ethics. We would like a full refund. I will never do business with or recommend this company ever again.”

    From Yelp:

    • “This place is so phony. They advertise prices they know will draw you in only to scam your credit card and personal information. Beware of identity theft if you give this company your information. I fell for it and now have canceled the cc I gave them and locked down my credit with the bureaus.  DO NOT FALL FOR IT.”

    Upon reading further it becomes clear that these unscrupulous practices are not limited to the COVID-19 situation. These companies have used whatever situation they can to scam people out of their money, including the changes in management and ownership.

    Avalon Vacation Club Class Action Lawsuit

     

    Another comment on TripAdvisor stated the following:

    • “Just a hunch but the Avalon Grand likely got caught up in the trustee sell off of Michael Kelly’s properties, its former owner/operator, as part of a plea agreement he has made regarding some of his pending fraud charges in the U.S. referencing Time Share/ Vacation Club Fraud and Investment. The U.S. Federal Courts have been seeking any and all of Kelly’s assets in regard to the case(s) for reimbursement for victims/investors, many senior citizens, that Kelly ripped off to the tune of potentially hundreds of millions. The Avalon Resorts were just one of many Kelly businesses in the region acquired at the expense of the fraud. It would come as no surprise that the Avalon Resorts were sold off at auction, outright, piecemeal, or otherwise.

    The TCPAA page on Avalon Vacation Club affirms this: 

    • “Operated by Operadora Hoteles in Cancun, Mexico, Avalon Resorts experienced bad publicity when the resort owner, Michael Kelley, was tried for operating a Ponzi scheme in 2007. Since then, Avalon Resorts completed extensive remodeling to incorporate environmentally friendly features and focus on creating family retreats.” 

    Looking up the SEC press release “SEC Charges 26 Defendants in $428 Million Securities Fraud That Targeted Senior Citizens and Retirement Savings” will give you more information on this situation. 

    The class action lawsuits don’t stop there: in 2017, there was an Anticybersquatting Consumer Protection Act and Trademark Infringement case currently pending in the United States District Court for the Southern District of Florida between Vacation Store of Miami and Heron Development Corp. (US District Court for Southern District of Florida – Miami Division Case No. 1:16-cv-20683-FAM). 

    You can search these terms for more information about the case, but essentially, the Vacation Store of Miami used several different domain names unethically to not only steal business from another company, but also to falsely appear as if they were associated with many other companies. One Yelp review echoed this quite recently, so apparently they are still doing this:

    • “This is a scam company. The company creates websites that look like the hotel, so you think that you’re making reservations directly through the hotel. Unfortunately, I didn’t look closely enough at the website and realized the error when they emailed my confirmation. I’m trying to cancel reservations I made for July of this year (it’s May now), but I cannot reach the company through phone or email. Their phone number doesn’t even have an answering service to take messages. it rings and rings and then just hangs up. RED FLAG.”

    So with all of this in mind, the bottom line is that if you have an Avalon Vacation Club timeshare, you definitely want to do everything you can to get out of it.

    Unsurprisingly, we did not find an official exit program on either the Hotel NYX Cancun or the Vacation Store of Miami websites for the Avalon Vacation Club. The Avalon Resorts website — the old one — is not functional, so there is nothing to search for there. 

    You can get in touch with Vacation Store of Miami’s customer service by going to the Contact Us page on their website. That said, the reviews and complaints indicated that this is often an ineffectual route to take. You may want to explore what a timeshare exit company can do for you instead. While resale is sometimes another way to get rid of Avalon Vacation Club timeshare, you might consider the circumstances surrounding the companies that own these timeshares, and opt to hold the resorts accountable by getting them to cancel your contract instead.

    Can You Get Rid of a Tau Resort Vacation Club Timeshare?

    Tau Resort Vacation Club is a timeshare program that is part of Táu Resort Nahui, located in Puerto Vallarta, Mexico. The resort itself appears to be managed by Interval International, a global timeshare company, and owned by Velas Resorts. It may have, at one point (about five years ago) been maintained by the Bel Air Collection, a resort company. 

    While Tau Resort Vacation Club appeared to be a legitimate investment to many people, it turned out that the properties they gave their money to had actually not been constructed yet. This construction apparently has never been completed judging by what’s available as far as information online. 

    There are a few other resorts with similar names — Casa Táu, Táu Beach Club, and Táu Residences — that are located in the same area. These have been announced very recently (i.e. earlier 2021) so it would appear that the resort and company have been operating under a few different names. However, that does not by any means indicate that their situation has changed. In fact, their newness may imply that they’re very much operating the same way. 

    As it stands, this situation is just one of many reasons people seek to cancel Tau Resort Vacation Club timeshare. Some of the other related reasons include the following: 

    • High pressure sales tactics 
    • Bait-and-switch practices with rooms and properties
    • Misrepresentations in contracts, particularly calling timeshares “real estate” 

    Our attempts to find more information on this resort proved difficult, but we ultimately did find several relevant complaints. The following were a few of the most prominent. 

    From TripAdvisor:

    • “During our recent trip to PV, we experienced a timeshare presentation at the Tau Resorts. I’m writing this to help others avoid taking vacation time for a presentation at the Tau Resorts. My spouse and I soon after this experience decided that this will be our last timeshare (aka fractional ownership) presentation. … By the time we got to the Tau Resort, the OPC had exchanged our original paperwork for replacement paperwork, with a specified gift of much less value that would come from the OPC himself, and this was what he presented to our handlers at the Tau Resort. In the end, our received honorarium was less than 1/5 of what we were first led to believe.”
    • “Tau promised owners who purchased by the end of December 2010,that the completion date was July 15, 2011 and those that purchased first week of Jan 2011 that the completion date was Dec 15, 2011. A home builder said to me that there is no way that the resort will be completed by Dec 15 based on what was seen on August 28, 2011. It will take hundreds of workers and heavy equipment to finish a project of that size. Your best bet is to start the recovery process of getting your money back.” 

    A few responses to these comments included:

    • “I am trying to reach them to no avail. Actually, it is the My Preferred Travels Limited that got my red flag up, because they are the entity that took care of my timeshares in trade and now they are nowhere to be located. Emails bounce back, and telephone is out of service! Tau does not answer their phone nor return calls. Highly disappointed- any news/help?”
    • “Beware of Tau Resorts. … As a personal note, we drive by there frequently and there is absolutely ZERO construction going on in their shell structure.. It´s been like that for years. Sadly, I think it´s a non-starter.

    We also found that, while Tau Resort Vacation Club does not have much in the way of online reviews, the managing company Velas Resorts has several negative reviews and 3 stars on ComplaintsBoard. The Bel Air Collection, also called the Bel Air Vacation Club (or Owners Circle) has an F with the BBB. 

    There are also around 60 positive/five-star Google reviews of the resort itself that are pretty spare and nondescript, with a few noting that it still isn’t finished but “will be great when finished.” So we would definitely call this a red flag. 

    Unfortunately, based on all of these glaring red flags, our evaluation is that Tau Resort Vacation Club appears to be a scam. But that doesn’t mean you can’t get out of Tau Resort Vacation Club timeshare. There are a few options that you can try to get released from your contract.

    Tau Resort Vacation Club Exit Program

     

    Sometimes resorts like this one will feature an official exit program on their website in order to keep people from using a third party to cancel Tau Resort Vacation Club timeshare. This isn’t the case with Tau Resort; on the website for their current iteration, Casa Táu, the timeshare program isn’t listed either. Your best bet for getting in touch with the resort would be via the Contact page, where there is an email address that you can use for a more direct connection. 

    Based on the customer experiences cited above, we can only conclude that it is difficult enough to get rid of Tau Resort Vacation Club timeshare directly that it isn’t truly an option.

    While we did not find any class action lawsuits that directly involved Tau Resort Vacation Club or any of its managing agents/owners, there is a trail of fraud that involves one of its developers. There are two sources you can look into to find out more about this history. First, the article “NAFTA claim is ‘last resort’ in fraud case” with Mexico News Daily highlights how the developer Héctor Cárdenas Curiel borrowed money to start Tau Resort, but the resort was never built. There is also a Blogspot page called “C&C Capital Fraud” that has further information about Curiel, and other properties he has used for fraudulent activity. Again, while there has not yet been a lawsuit, this background is something you should be aware of and keep an eye on if you’ve invested in Tau Resort Vacation Club.

    When it comes to fraudulent timeshare companies like Tau Resort Vacation Club, your best bet is to work with a legitimate and reputable timeshare exit company, especially one that has a background in the legal field and a track record of success getting people out of vacation properties.
